Trump's NY tax returns now available to Congress under new law

The leader of the New York Republican Party says a new law allowing President Donald Trump's state tax returns to be handed over to Congress is an overtly partisan attack that won't stand up in court.

The House Ways and Means Committee, the Senate Finance Committee or the Joint Committee on Taxation could file a request with NY state if efforts to gain access to federal tax filings through the Treasury Department fail.

"Tax secrecy is paramount - the exception being for bonafide investigative and law enforcement purposes", Cuomo said in a statement.

"As the home state of Donald Trump, New York has a special role to play to help avoid a constitutional crisis between the president and Congress in their effort to obtain his tax returns", Manhattan state Sen.

The state tax documents from NY - the president's home state and business headquarters - would likely contain much of the same information as the contested federal returns, tax experts say.

In May, Treasury Secretary Steven Mnuchin denied the House Ways and Means committee's request that the Internal Revenue Service turn over six years of Trump's federal tax returns, citing his belief that the committee did not have a legitimate legislative reason for the request. Last week, Neal sued the IRS and the Treasury Department for those federal returns.

Existing laws generally prohibit the release of tax returns.

The 37 subpoenas seek information from Trump's businesses including the Trump organization, Trump Tower, his hotels in NY and Washington, D.C., and his Mar-a-Lago Club in Florida related to a case by 200 Democrats alleging the businesses violate the constitutional ban on gifts or payments from foreign governments. "That may cause the chairman of the Ways and Means Committee to change his mind".

"I am confident that the courts will recognize that New York State has the full authority when it comes to New York State tax returns", Buchwald said.

Neal has issued subpoenas for six years of Trump's tax documents, but Treasury Secretary Steven Mnuchin has so far resisted, saying Congress' request "lacks a legitimate legislative objective".

"At this moment in time Chairman Neal has taken this position, but we'll see how he decides to proceed in the face of continued obstruction from the administration", Rep. Hakeem Jeffries (D-N.Y.) said. Trump has spoken about the possibility of pardoning those accused or convicted of crimes stemming from former special counsel Robert Mueller's investigation.
