Alabama DROPS manslaughter charges against pregnant woman

"There are no winners, only losers, in this sad case", said Washington.

Washington, who was flanked by religious and spiritual leaders while reading her statement, said that the tragic facts of the case led her to believe that pursuing charges against Jones was not in the best interest of justice.

"This is truly a disturbing and heartbreaking case", Washington told a news conference.

"The members of the grand jury took to heart that the life of an unborn child was violently ended", said Washington. The woman who fired the shot was not charged, as it was determined she was acting in self defense.

The shooting happened about noon on Tuesday Dec. 4, 2018 outside Dollar General on Park Road, said Pleasant Grove police Lt. Danny Reid.

A Jefferson County grand jury indicted Marshae Jones, 28, for manslaughter on May 1, concluding she intentionally caused the death of her fetus in December by starting the fight with the woman who shot her but was not charged.

"The citizens took the evidence presented them by the Pleasant Grove Police Department and made what they believed to be a reasonable decision to indict Ms Jones", she said.

In Jones' case, this concept has been extended in a way that her lawyers charge is "illegal, inappropriate and unprecedented". The legislation was passed for the express objective of provoking a test case before the US Supreme Court, where the anti-abortion fanatics hope to achieve their long-sought goal of overturning the precedent set by the high court in 1973. Jones was allegedly the aggressor in the fight between the two and, according to authorities, continued to instigate a confrontation even after Jemison had gotten into her auto to avoid the dispute. At the time, Jones, Jemison and the father of Jones' unborn child all worked together at a charcoal plant.

On Monday, Jones' attorney filed a motion to dismiss, saying "Using a flawed and twisted rationale, the State of Alabama has charged a new theory of criminal liability that does not lawfully exist".

As Jones's lawyers have explained, she is facing a charge of taking a human life because she was involved in an altercation in which she herself was shot and wounded.

The law immediately prompted a legal challenge and has not taken effect.

The attempted prosecution of 27-year-old Marshae Jones is part of the escalating effort to reverse the 1973 US Supreme Court decision that legalized abortion by granting full legal rights to the human fetus. They argue that the "unreasonable, irrational and unfounded indictment is fatally deficient and is due to be dismissed".

In her first public remarks on the indictment of Marshae Jones, Jefferson County Bessemer Cutoff District Attorney Lynnice Washington, speaking passionately before a predominantly black audience told critics: "I am a black woman in black skin".

The American Civil Liberties Union said in a statement that Jones should never have been indicted.

The ACLU on Wednesday praised Washington's decision.
