Florida Woman Arrested After Giving Husband's Guns to Police

A Florida mom suspected of shooting and killing her stepfather and her 7-year-old daughter was arrested, police said.

A Florida lawmaker is warning a state attorney Monday that it would set a "scary precedent" if he prosecutes a woman who recently was arrested after taking firearms from her estranged husband's home to turn in to police.

The following day, Mrs Irby went to her husband's house, gathered up the firearms and brought them to the Lakeland Police Department.

"So you are telling me you committed an armed burglary?"

She claimed Mr Irby "wasn't going to turn them in" so she chose to do it herself.

News of her arrest sparked outrage and got the attention of state Rep. Anna Eskamani, D-Orlando.

While federal law prohibits people under domestic violence restraining orders and convicted of domestic violence from possessing guns, local law enforcement and prosecutors don't have the tools they need to enforce those restrictions, Eskamani said in her letter to the state attorney. Mrs Irby knowledgeable officers she feared for her lifestyles throughout the confrontation and had requested restraining orders on Mr Irby within the previous. Irby's vehicle allegedly was rear-ended by the vehicle of her husband, who was attempting to run her off the road while she was on the phone with police.

Joseph Irby, 35, was arrested on a domestic violence aggravated battery charge and released on $10,000 bail the next day.

After her husband's arrest, Courtney Irby petitioned for a temporary injunction for protection, which was granted. "We know with so many survivors of domestic violence that asking for help is the biggest challenge".

The on-duty officer then made contact with Joseph Irby, who was still incarcerated at the Polk County Jail. Sabin, a former candidate for the Polk County School Board, said she felt compelled to help Irby after hearing about the arrest.

Both Mr and Mrs Irby are due in court but again in July.

Sabin said she learned that she and Irby have mutual friends.
