There will be three days of visitation for Ochoa-Lopez on Thursday, Friday and Saturday.

They did not get that answer Monday but they said they did get reassurance that the baby boy, as grim as his prognosis may be, is getting the best possible care.

"If there were evidence of a hospital not following any state or federal law, the hospital could be cited with a violation and be required to take corrective action", Melaney Arnold said in a email to CBS 2.

The tiny baby featured a full head of dark hair and appeared to open his eyes slightly in one photo taken inside a hospital room.

Once Ochoa-Lopez showed no signs of life, Figueroa cut her open with a butcher's knife, removed the placenta and the baby, then put the baby in a bucket with the umbilical cord still attached, Mr Murphy said, reading from court documents.

Cara Smith, chief policy officer at the sheriff's office, said if the state's Department of Family Services determines that Advocate Christ Medical Center violated the Abuse and Neglected Children Reporting Act, there would be an investigation.

Marlen Ochoa-Lopez was lured to the Chicago property several times. Her funeral will be Saturday, in Stickney, Illinois.

Chicago fire officials confirmed firefighters responded to an address for a baby in distress, the baby was rushed to a nearby hospital and remains in critical condition.

When Ms Ochoa-Lopez arrived at Figueroa's house on April 23, Desiree showed her a photo album of her late brother to distract her as her mother started strangling her with a cord, prosecutor Jim Murphy said.

Officials then went to Figueroa's home, and her daughter told police that her mother had a baby.

The hospital's handling the case has raised questions, particularly since the Chicago Police Department and the state's Department of Children and Family Services both said last weekend that staff at the hospital did not alert them after determining that Figueroa had not just given birth to the gravely ill newborn.

The family's lawyers say they want to understand how a woman who's now an accused killer was allowed to roam this hospital unchecked. Family members say authorities suspect this is a fetal abduction case, NBC News reports.
