Special counsel notes Michael Flynn's cooperation, recommends no prison time

Special Counsel Robert Mueller just released the sentencing memo for former National Security Advisor Michael Flynn who pleaded guilty to lying to the Federal Bureau of Investigation about his contacts with Russian Ambassador Sergey Kislyak in 2017.

"The memorandum states that the defendant, Michael T. Flynn provided 'substantial assistance to the government", and the Mueller team has recommended a sentence "at the low end of the guideline range-including a sentence that does not impose a term of incarceration-is appropriate and warranted". To discuss the latest in the Russian Federation probe, Jim Braude was joined by former United States attorney Don Stern, who worked alongside Robert Mueller both during his stint with the Department of Justice, and in private practice at Hale and Dorr; and Nancy Gertner, retired federal judge and senior lecturer at Harvard Law School.

Flynn could face up to five years in prison and a fine of up to $250,000, but is likely to receive a lesser sentence. Cohen's sentencing date is set for December 12. He also pleaded guilty to tax fraud and campaign finance charges in a separate court case.

Thirty-three people and three companies have been charged in the probe, including Cohen, Trump's former lawyer who last week pleaded guilty to lying to Congress when he insisted that Trump was pursuing plans to build a Trump Tower in Moscow in 2016. Most notably, Trump former campaign chairman, Paul Manafort, aggressively fought the investigation and is now facing the possibility of a lengthy prison sentence after his cooperation agreement recently fell apart over allegations that he had lied to investigators.

Once a distinguished military officer with decades of government experience, Flynn - who's now retired - forged a close bond with President Trump during the 2016 campaign as an adviser and surrogate. He has instead spent considerable time with his family and worked to position himself for a post-conviction career.

After the plea deal, Trump attacked Cohen as weak and a liar.

According to court papers, in mid-December 2016, Kushner directed Flynn to reach out to several countries, including Russian Federation, about a U.N. Security Council resolution regarding Israeli settlements. One knowledgeable source said the bulk of Flynn's cooperation with the special counsel occurred immediately following his December court appearance. Gates pleaded guilty to a conspiracy charge related to financial crimes and to lying to FBI investigators.

Flynn pleaded guilty to "willfully and knowingly" make "fictitious and fraudulent statements" to the Federal Bureau of Investigation to cover-up meeting with then-Russian ambassador Sergey Kislyak. The White House has said that Flynn misled officials - including Vice President Mike Pence - about the content of his conversations. According to the documents, Flynn met with Mueller's team and the Justice Department 19 times for interviews.
