Trump to announce Supreme Court nominee


President Donald Trump has nominated Brett Kavanaugh to join the US Supreme Court, setting the stage for a dramatic confirmation battle over a stalwart conservative who could shape the direction of the court for decades to come.

"Throughout legal circles he's considered a judge's judge, a true thought leader among his peers", Trump, who named conservative Justice Neil Gorsuch to the court past year, told an applauding audience in the White House East Room.

He also worked in the solicitor general's office in the George H.W. Bush administration before clerking for recently retired Supreme Court Justice Anthony Kennedy.

Democrats see the seat being vacated by Justice Kennedy, a conservative judge who sometimes sided with the court's liberal wing, as critical to maintaining abortion rights and key provisions of former President Barack Obama's healthcare plan. Joe Donnelly of Indiana, Heidi Heitkamp of North Dakota, Doug Jones of Alabama, Joe Manchin of West Virginia and Dianne Feinstein of California. At the top of that list is abortion.

This year, Kavanaugh authored a dissent to a D.C. Circuit decision to allow a teenaged immigrant to get an abortion, writing that it "is ultimately based on a new constitutional principle as novel as it is wrong: a new right for unlawful immigrant minors in U.S. Government detention to obtain immediate abortion on demand, thereby barring any Government efforts to expeditiously transfer the minors to their immigration sponsors before they make that momentous life decision". Mitch McConnell, R-Ky., the majority leader, has tried to warn the president through gentle nudging that Hardiman and Kethledge would be the safest choices for confirmation. But he had made his final decision, according to a person with knowledge of the president's thinking who was not authorized to speak publicly. But his supporters cite his experience and wide range of legal opinions.

Democrats have turned their attention to pressuring two Republicans, Sens. Susan Collins of ME and Lisa Murkowski of Alaska, to oppose any nominee who threatens Roe v. Wade.

Democrats are certain to press Trump's latest nominee on the landmark 1973 Roe v. Wade ruling that legalized abortion nationwide, a decision some conservatives - particularly conservative Christians - have long wanted to overturn. The two have supported access to abortion services.

"What matters is not a judge's political views, but whether they can set aside those views to do what the law and the Constitution require".

While the president has been pondering his choice, his aides have been preparing for what is expected to be a tough confirmation fight. Kennedy administered the judicial oath to his former clerk.

Kavanaugh, 53, is said to be supported by White House Counsel Don McGahn, who's supervising the search. During his time as a Senator, he participated in the confirmation hearings of four Supreme Court justices. Kennedy ruled multiple times in favor of abortion rights during his 30-year Supreme Court tenure. After his renomination, the Senate voted 57-36 in 2006 to confirm him. Of the court's liberal justices, Ruth Bader Ginsburg is 85 and Stephen Breyer turns 80 next month, so Trump may well get another opportunity to cement conservative dominance of the court for years to come.
