Reuben Foster of San Francisco 49ers has felony domestic violence charges dropped

Klippen announced Wednesday afternoon that two felony charges pertaining to an alleged domestic violence incident have that were levied against San Francisco 49ers linebacker Reuben Foster have been dropped. "As a result, he will have the opportunity to rejoin the team tomorrow", the statement read.

Lynch also made it clear that Foster's place on the roster is not guaranteed moving forward, and it sounds like he'll be on thin ice in the coming years. The judge also reduced the weapons charge to a misdemeanor. "We will continue to monitor the remaining misdemeanor charge". Since Foster was charged, Ennis has testified at his preliminary hearing that she lied to police.

However, the judge also said the dismissal was more than about a recanted statement.

Additionally, Klippen said there was no evidence that Foster previously abused Ennis, that Ennis feared Foster physically harming her or that he offered to compensate her in exchange for changing her original story. "No broken bones, no bruises".

Foster pleaded not guilty May 8 to felony domestic violence, forcefully attempting to dissuade a witness and possession of an assault weapon, and invoked his right to a speedy trial. Ennis also stunned onlookers in court that day by admitting she had previously been arrested in Louisiana for filing a false domestic violence report against another ex-boyfriend in 2011 when that man tried to break up with her.

Klippen wondered aloud Wednesday how Ennis could have regained her composure in the 10 minutes between the first 911 call, when she reported being hit, and the second call. "But at the same time, I just don't understand why prosecutors hung their hat on this case", she said.
