Palestinian FM to press ICC on war crimes probe

This request by minister Riad Malki is sure to worsen the relations between the already sparring two nations.

The protests peaked on May 14, the day the United States moved its embassy in Israel from Tel Aviv to Jerusalem.

Commenting on the Palestinian referral to the ICC on Tuesday, the Israeli foreign ministry said the request is "legally invalid".

Here is a closer look at the Palestinian move and its implications. During the opening ceremony of the US Embassy in Jerusalem, violence peaked to a level unseen in previous weeks. In 2004, the United Nations' highest judicial organ, the International Court of Justice, ruled in an advisory opinion that the settlements breached international law.

"The ICC lacks jurisdiction over the Israeli-Palestinian issue, since Israel is not a member of the Court and because the Palestinian Authority is not a state".

Tuesday's referral allows that investigation to proceed to the next stage of a full investigation, without waiting for a judge to give approval.

The comments came a day after Palestinian foreign minister Riyad al-Maliki's arrived in the Netherlands, where he held talks with the the ICC's Chief Prosecutor Fatou Bensouda in order to update her on the situation.

Among ors, death of civilians without legal cause, expulsion of Palestinian people in occupied territories, illegal appropriation of ir lands, demolition of ir houses and premises, and Israeli policy of "arbitrary detentions" are included.

The referral will include Israel's past, present and future war crimes and crimes against humanity against the Palestinian people.

Since March, Gaza had witnessed massive Israel-Palestine clashes that have claimed lives of more than 100 people including 60 Palestines and injuring several others.

Jordan and Egypt ruled over those territories for 19 years without global recognition, and then the area was taken away by Israel in June of 1967. But that position is not internationally recognized. The maps of West Bank drawn by United Nations resemble a leopard skin, where almost three million Palestinians are surrounded and isolated.

Concerning the recent bloodshed in Gaza, Israel has accused the territory's Hamas rulers of using a series of recent mass protests as a cover for attacks and endangering civilians by using them as human shields.

Some of the protesters have burned tires, thrown firebombs or tried to break through the fence. Amnesty International called the situation in Gaza "another horrific example of the Israeli military using excessive force and live ammunition in a totally deplorable way".

The ICC is a court of last resort. A delegation of prosecutors and magistrates traveled in October 2016 to Jewish state on an informative mission to avoid suspicion and to raise awareness of task of worldwide criminal justice.

Israel, which is not an ICC member, says the court does not have jurisdiction.

Both Palestinian and worldwide rights groups have long called for the ICC to open a formal investigation.
