Lawyer: Homophobic slur led to Waffle House incident

Wall said he was defending his sister and her friends from a negative comment from a Waffle House worker when an argument started. That is when he said Waffle House employees called the police.

"This is a national, corporate issue they need to address", Crump said.

Anthony Wall, 22, had just finished escorting his 16-year-old sister to prom and stopped into the popular restaurant to grab a bite to eat. She called for a boycott until the restaurant chain implements training for its employees on racism.

Four cruisers responded to the call at Waffle House, but Wall was placed in one with a K-9 unit in the back. The company spokesperson also noted Wall told ABC11 he took full responsibility for his interactions with Waffle House employees. Police officials are not a private security force for untrained Waffle House employees.

Waffle House CEO, Walt Ehmer, has reached out to Anthony Wall to apologize, but Crump doesn't believe that's almost enough to fix a deeper problem that lies within the company.

Wall was charged with disorderly conduct because of his actions inside the restaurant and was charged with resisting arrest in connection with his encounter with Warsaw Officer Frank Moss, which was captured on cellphone video.

"I was pretty much trying to scream for air and trying to breathe because he was holding my throat and that's when I got aggressive with him because you are choking me", said Wall. "Wall from the gay and lesbian community discriminated against next month", Crump said.

The video, however, does not show what kicked off the heated, shrill argument.

"The use of force choking him was excessive and inappropriate", said Wall's attorney Allen Rogers.

The FBI is now joining the investigation into the Warsaw Waffle House incident.

Connors praised the arrest, and twice denied that race played a role. "He was there. He started a fight - this officer did what he had to do". The situation escalated from there to include another Waffle House employee who was notably black.

Crump said he was investigating whether Waffle House discriminates against black and LGBT customers after several incidents reported around the U.S.in recent weeks.

The officer involved has not been identified, but we're told he is back on the job.

Rogers and Crump both blasted the mayor's claim that race wasn't a factor. "That was the first statement that he makes to these young people".

".we must understand that this young man had broke the law".

Wall also later stated that he was to blame, along with the Waffle House staff, for the escalation of the fight. Travis Reinking was arrested without incident in the April mass shooting following a manhunt. Wall, who had taken his little sister to her prom that night and was wearing a tuxedo, was subjected to homophobic slurs by staffers, his attorney said. His lawyers are demanding the release of police body camera footage and surveillance video from the restaurant.
